The Supreme Court ruled 6–3 on Wednesday to uphold a Tennessee law that bans gender-affirming care for minors experiencing gender dysphoria, shielding similar laws in more than 25 other states.   The question before the court was whether the state law — which encompasses puberty blockers, hormone therapy and surgery with the goal of medically transitioning a minor’s gender — violated the Equal Protection Clause of the 14th Amendment.   Chief Justice John Roberts, writing for the majority, acknowledged the “fierce” scientific and policy debates surrounding the treatments “in an evolving field,” but said those matters were best left for the people to decide.   “Our role is not ‘to judge the wisdom, fairness, or logic’ of the law before us, but only to ensure that it does not violate the equal protection guarantee of the Fourteenth Amendment,” he wrote.   “Having concluded it does not, we leave questions regarding its policy to the people, their elected representatives, and the democratic process.”   Tennessee lawmakers enacted the ban in 2023, citing a “compelling interest” to protect minors from physical and emotional harm.   Three Tennessee families and a doctor sued, and the Biden administration joined them, arguing the law amounted to sex discrimination.   The high court rejected that argument, saying the law distinguishes based on a treatment’s medical purpose, not sex.   Justice Sonia Sotomayor, writing for the court’s liberal wing in a blistering dissent, said the decision would cause “irrevocable damage” to the Equal Protection Clause and invite legislatures to engage in discrimination.   “By retreating from meaningful judicial review exactly where it matters most, the court abandons transgender children and their families to political whims.
