[context] Malicious Comment Targeting NewJeans’ Hanni: “You Think Crying Will Help?” — Escapes Criminal Record A netizen who left a malicious comment toward Hanni, a member of girl group NewJeans, saying “You think crying will get help?” has escaped the risk of having a criminal record. Although the netizen was prosecuted and brought to court after Hanni filed a complaint, they narrowly avoided punishment by reaching a settlement. According to legal sources on the 27th, Judge Kim Gil-ho of the Criminal Division 14 at the Seoul Southern District Court dismissed the indictment against the accused, A, on charges of defamation. Dismissing the indictment is a legal procedure that ends the case without punishing the defendant. Before the sentence was handed down, A reached a settlement with the victim (Hanni). Hanni submitted a withdrawal of her complaint to the court, allowing A to avoid punishment. Because defamation is a “complaint-based offense” (친고죄 / chin-go-jwe), if the victim withdraws the complaint, the offender cannot be punished. A complaint-based offense is a crime in which the prosecutor can only bring the accused to court if the victim files a complaint. Even if the case has already started, if the victim withdraws the complaint, the court dismisses the indictment and closes the case. The court explained, “As the withdrawal of the complaint has been received, the indictment is dismissed.” The ruling is now final. Meanwhile, Hanni’s complaint about workplace harassment was not recognized.
