There was drama yesterday as state lawyers threatened to interdict the Sunday Times from publishing its two-year investigation into the looting of the R300-million secret service fund under the control of crime intelligence boss Richard Mdluli. The investigation reveals that businessman Panganathan "Timmy" Marimuthu, a close friend of suspended national police commissioner Bheki Cele, with a previous conviction for drug dealing, and his family received over R1.6-million from the secret fund in less than two years. Documents obtained show a shocking pattern of nepotism and misuse: Marimuthu successfully got several relatives and friends hired as "secret agents", including his wife Neermala Moodley, daughter Shantal, son Lonvendren, brother Christie Marimuthu (a former police officer with prior criminal accusations), his son-in-law Viganderan Redhi, and close friend Ariffa Govender. Medical claims totaling more than R37,000 were submitted in September 2011 for dental work done on Marimuthu in Umhlanga, including crown replacements. His son, Lonvendren, claimed from the fund’s medical aid for treatment of acute bronchitis. Nearly R50,000 was claimed for the delivery of Marimuthu’s grandson to daughter Shantal, who had been signed up as an "agent" at R25,000 a month and granted the rank of lieutenant-colonel. Rental payments of R25,000 per month for 36 months were made to Ephesians 321 Construction, owned by Shantal, for “safe premises.” A January 2011 letter to Major-General Solly Lazarus claimed the premises were needed for Cele to meet undercover agents with a “cover story that is watertight and would withstand any deep scrutiny.” While police are permitted to sign up secret agents, they are generally not allowed to recruit individuals with criminal convictions. Evidence suggests the decision to include Marimuthu and his family was a political maneuver orchestrated by corrupt crime intelligence officials. State lawyers contacted the Sunday Times yesterday demanding access to documents, threatening legal action. After discussions, no interdict was launched. The ties between Marimuthu and Cele go back to Cele’s tenure as KwaZulu-Natal MEC of Transport. VIPs at Marimuthu’s lavish 50th birthday party in La Lucia, Durban, included Cele, Lazarus, and Major-General Dina Moodley, head of crime intelligence in KwaZulu-Natal. Mdluli’s own family members were reportedly signed up as covert agents and implicated in looting the secret service fund. Marimuthu’s criminal history includes: 1985: Charged with murder. 1992: Convicted for dealing 3,990 mandrax tablets, sentenced to three years but never spent a day in jail. Evidence to the 2002 Jali Commission suggested he paid R100,000 to Westville Prison officials to avoid imprisonment. He was identified by Major-General Mark Hankel as a central figure in looting the secret service account. Further privileges include: Access to a black BMW X5 fitted with police-style blue lights for over a year, purchased with secret service funds. The vehicle reportedly disappeared after internal scrutiny. Signed up as a "secret agent" in early 2011 following a recommendation from an intelligence officer who called him a “critical element” of a network of interest to crime intelligence.
