Can the result of the roadside breath test be used to prove a provincial traffic offence? For example, to prove a class 7 driver had more than 0mg% of alcohol in their body and drove contrary to their driver’s licence restriction.

I don't like the majority of lawyers who are giving advice on the Internet, because they never tell where they are from. This is bigger than American versus Canadian, because the laws can vary from state to state and province to province. I appreciate that you make it clear where you are from and that laws differ across the country

Well I guess the police department where I live wasn't trained on that plastic when I had a breathelizer he had it grainy hands all over it as he pulled it out of the plastic and threw the plastic away

I never had a drink,and the OPP was parked outside the liquor store,they saw me going in and coming.then they fallowed me until I turn the corner and when the LCBO was out of sight,,they pulled my over.how does that not violate the charter of rights?.

if a cop asks for a breath test and the person is unabke to satisfy due to medical issues after trying does the officer have the descretion to offer another option or is it game over the hands are tied by procedure and the cop has to record it as refusal.

I had a friend get rear-ended and got injured. Concussion and stitches needed. We were in another car. She had been drinking. We advised her to go to the hospital in the ambulance so she wouldn't get breath tested. I assume they can request blood from the hospital, but what is the procedure for that?
