This is the buyer’s fault for not doing their research before hand. One simple phone call to the tax office in their county or parish could’ve given them this information before closing.

That’s why people have to do their diligence on everything. Say for instance my dad bought a lot and was building a house on it to sell. He’s only paying the Construction interest part of the loan. which doesn’t have the updated taxes part on it bc the house there now. if people would tell the company to have it appraised now that the house is on it. They can see the true taxes on it then they would know their true payment because then the construction company knows what portions gonna come out of their money when the house is sold for the updated tax version. That they have to pay.

It is up to the lender to educate people. But as a realtor I also make sure that I educate my clients on taxes. You can go get tax estimates from your county website to see what your taxes should look like (estimated). Ensure that your lender uses the correct estimated taxes on the property and not just the land. So important to do your due diligence. If your agent and lender are not educating you, you need a new one🥰

I always tell my clients to assume 1.25% as taxes and let them know that the payment WILL go up or I have the builders loan officer make sure the escrow is calculated correctly

Everyone is failed the client in this case… LO should have made the client aware of the tax increase once land and structure is taxed together. Realtor failed the client by not asking the builder for the tax rate (without homestead) and calculating the payment from there. Not their job, but in this market as a realtor, you need to stand out by understanding financing to better protect your client.

I think it falls with everybody. A good real estate agent should make their client aware of all line items as it pertains to their potential mortgage pymt. The builder is wrong for the deceptive practices. The homebuyer needs to do research before buying a home.

always do your research. just because you get approved for 500k doesn't mean to buy 500k depending on your area try to get as low as possible so you can have the flexible area so property taxes and insurance can get paid

I say is you cause you should do your own investigation? You should know that when you buy a house and they give you that cheap payment it does not include taxes and insurance and that’s where people seem to not understand. They fluctuate a lot and not only that the interest rate and if you have a balloon rate.

Most prospective buyers who use builders dont use realtors… the builders refuse to pay Realtors for their work… my client bought new construction but when with her own lender… the closing cost the builder offered changed immediately she didn’t use them but she was well informed. Also please note the builders dont pay extra in addition to the brokerage fee. If your agreement is 2.5% builders dont even pay that which means the buyer pays the difference

Mind blowing. Current DRH sales rep and I’ve been one in Texas and Louisiana. Me and my DHI lender ALWAYS discuss property taxes and I make sure they see the MFO before we even do a contract. Being a previous LO and Realtor, I like to be transparent about everything! It’s truly disheartening to see the company being named in a RICO 😳.

I’m one of the litigants. We have been told that WE (the buyers) don’t have any recourse and that we should have read our contracts. Nah…I encourage anyone experiencing these issue to not back down and hold these people responsible.

Idc where it is in the state or in the country, I always have my clients assume 1.1% on property taxes. Whether the builder/lender does it or not. And keep a cushion beyond that
