The judgment was almost airtight, but there is a clear weak point. The prosecution did not prove beyond reasonable doubt that his broadcasts directly led to the deaths of those people. To establish that, they ought to produce either eyewitnesses who saw the attacks, or the perpetrators themselves, or at least someone who could testify: “I obeyed his order.” None of that evidence was called. However, the court relied heavily on Nnamdi Kanu’s own confessional statements, where he allegedly admitted that his broadcasts and sit-at-home directives resulted in violence and loss of lives. That confession was treated as voluntary and became the bridge that cured the lack of eyewitness testimony.
